By accessing or using MemPad ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

Description of Service

MemPad is a cloud-based memory storage service that enables AI assistants to maintain persistent context across conversations. The Service allows you to store, retrieve, and manage text-based memory content accessible via the Model Context Protocol (MCP).

Account Registration

To use MemPad, you must:

  • Provide accurate and complete information
  • Be at least 18 years old or have parental consent
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access

You are responsible for all activity that occurs under your account.

Acceptable Use

You agree not to use the Service to:

  • Store illegal content or content that violates others' rights
  • Attempt to circumvent usage limits or security measures
  • Interfere with or disrupt the Service
  • Use automated systems to abuse the Service
  • Resell or redistribute access to the Service

We reserve the right to suspend or terminate accounts that violate these terms.

Service Tiers and Limits

MemPad offers different service tiers with varying storage and usage limits:

  • Free tier: 5 KB storage, 100 reads/day, 100 writes/day
  • Paid tiers: As specified in your subscription

We may change tier limits with reasonable notice. Exceeding your tier's limits may result in rate limiting or service suspension.

Your Content

You retain ownership of all content you store in MemPad ("Your Content"). By using the Service, you grant us a limited license to store and transmit Your Content as necessary to provide the Service.

You are solely responsible for Your Content and ensuring it does not violate any laws or third-party rights.

Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

Intellectual Property

MemPad and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR BUSINESS OPPORTUNITIES.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the past 12 months, or $100, whichever is greater.

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting us. Upon request, we will delete your data in accordance with our Privacy Policy.

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or by posting a notice on our website. Your continued use of the Service after changes constitutes acceptance of the new Terms.
